ABSTRACT

This case holds a prominent stature when it comes to the interpretation and application of Article 121 of the Constitution. It transformed the convention of what can be considered as an ‘Other Authority’ within State and formulated a new test to aid the same. The analysis portion takes the reader on a journey of the good, the bad and the ugly aspects of the verdict, with a deeper lens donned on examining the objectionable portions. Furthermore, perspective is also provided on the implications of the judgement’s shortcomings, its future troubles and possible solutions to earplug its vulnerabilities.
