Legal Tug-Of-War: Ai’s Role In Security And Intellectual Property Rights

ABSTRACT
Artificial Intelligence (AI) has altered nearly every aspect of the industries, including finance, healthcare logistics, automotive, and aviation. Innovative technologies can detect irregular patterns, such as spam filtering or payment fraud, and alert organizations to dubious activity in real time, thereby aiding market growth. These innovations and creations are protected under several types of Intellectual Property (IP). However, the shift from AI-related inventions to AI-led inventions has presented significant problems to the current IP system. Along with this, it has presented new hurdles, such as ownership and copyright. As Artificial Intelligence evolves, it is critical to negotiate the issues and safeguard Intellectual Property Rights. Despite the numerous benefits of AI in the legal domain, certain problems about authorship and ownership of created works, as well as the impact on copyright, trademark, trade secret, and patent laws, must be addressed in a reasonable manner. The substantial goal of this article is to analyse the impact of AI on IP Rights, as well as the drawbacks that AI presents in
protecting Intellectual Property. Additionally, the author proposes suggestions to balance incentivizing AI innovation and protecting Intellectual Property Rights in India through an in-depth review of case
studies and legal precedents.
