ABSTRACT
This paper presents a comprehensive comparison effort to update and adapt the legal system to address the evolving needs of modern Indian society, encompassing various crimes and their corresponding punishments, which are effective in addressing sexual offences against women. Violence against women undoubtedly stems from significant power imbalances between men and women. And also analyse the legislative modifications made to The Code of Criminal Procedure, 1973, which will now be known as The Bharatiya Nagarik Suraksha Sanhita, 2023. It also highlights that the legal interpretation and application of these provisions can differ from case to case, depending on evolving legal standards and precedents. IPC 1860, CrPC 1973 and IEA 1872 and BNS 2023, BNSS 2023, and BSS 2023.
The comparative table highlights manly focused of the differences and new additions in the BNSS 2023, which was formulated to support the new laws of BNS, BSS and BNSS 2023. This aims to establish forensic evidence with a greater emphasis on electronic evidence and fingerprint impressions in BNSS 2023.
