ABSTRACT


The article “A Critical Evaluation of Modification of An Arbitral Award” This is an essential topic since Section 34 of the Act explains how to set aside an arbitral award given by an arbitral tribunal, which requires courts involvement. The courts’ assistance is needed for the smooth operation of the arbitration system; however, excessive intervention by the Court should be avoided in cases where applications against arbitral awards are entertained, as this would cause unnecessary delays in arbitral proceedings, defeating the Act’s objective. This Paper makes an evaluation of Section 34 of the 1996 Act and the setting aside of arbitral awards thereto, and the international scope of the section. Moreover, the article also talks about the limitation period with respect to the modification of an award.
