A New Era For Data Protection In India: Analysis Of Data Protection Act, 2023

ABSTRACT

2023 marks a revolutionary era for data protection data privacy in India.


In 2017, the landmark Supreme Court judgement of “Justice K.S. Puttaswamy v. Union of India” provided a glimpse towards the future and awareness required for data privacy. India lacked a prevalent, comprehensive and stringent data protection legislation which would be equivalent to “the European Union General data Protection Regulation” (“hereinafter referred to as, the “EU GDPR Regulations”).

The Government of India has been putting consistent efforts to bring into force a central legislation that could replace the SDPI Rules with an updated legislation. On August 11, 2023, the Digital Personal Data Protection Act, 2023 received the President’s assent ushering a new era for data protection and data privacy in India. 3
