ABSTRACT


This paper presents a comprehensive and critical study of the Police Complaint Authority (PCA) in India, focusing on its establishment, structure, functioning, effectiveness, and challenges. The PCA holds a pivotal role in ensuring police accountability and maintaining the rule of law. This study delves into the historical context that led to the creation of PCAs across various states in India and examines their legal framework as defined by the relevant legislations and guidelines. Furthermore, this study highlights the challenges and limitations faced by PCAs in India. These include issues related to inadequate resources, delays in case resolution, lack of awareness among the public about the PCA's existence, and potential conflicts of interest. The paper also discusses the interplay between political factors and the independence of PCAs, emphasizing the need for safeguarding their autonomy to ensure impartiality and fairness. In conclusion, the study underscores the significance of an effective and autonomous Police Complaint Authority in upholding the principles of justice, human rights, and democratic governance. It provides recommendations based on the observed strengths and weaknesses of PCAs, aiming to enhance their efficiency and credibility. As India continues to strive for a transparent and accountable policing system, this research contributes to the ongoing discourse on police reforms and the consolidation of a robust complaint redressal mechanism.
