Abortion And Its Legal Status In India

ABSTRACT

This research paper deals with discussion on Causing Miscarriage and Sections related to it in The Indian Penal Code, 1860. In this, Section 312, Section 313, Section 314, Section 315, and Section 316 of The Indian Penal Code, 1860 will be discussed.

This paper will also have a discussion on why Causing Miscarriage (Abortion) is illegal in India in comparison to few other foreign countries which have made it legal, what are the difficulties that Indians face due to Abortion being illegal in India and why should it be made legal in India.

In this, there will also be a description of what are the punishments that a person committing such offence will get, how is or on what basis is the punishment decided, what information should the person complaining disclose while they file a complaint.

Does Causing Miscarriage/Abortion to come under Rights for Women. If so, then by declaring it as illegal in India, is it violating the Right of Women?
