ABSTRACT


The purpose of the research paper on national emergency in India is to provide a comprehensive analysis of the legal, historical, and constitutional aspects of national emergency in India. The research paper aims to examine the provisions of the Indian Constitution that govern the declaration of a national emergency, the historical context of national emergency in India, and its impact on various aspects of Indian society. The scope of the research paper is broad, covering various aspects of national emergency in India. The paper will examine the constitutional provisions governing national emergency and the circumstances under which it can be declared.


The historical perspective will cover the three national emergencies that have been declared in India and their impact on the country. The research paper will also examine the impact of national emergency on fundamental rights, state autonomy, and the economy.


The research paper will also analyze the criticisms and limitations of national emergency in India. It will examine the potential misuse of emergency powers as a tool of political repression and the challenges of balancing national security with individual rights and democratic values.
