I. INTRODUCTION:
In the renowned legal case of ‘AIB Group (UK) plc vs. Mark Redler & Co Solicitors’1, the issues of ‘professional negligence’2 and ‘the duty of care’3 owed by lawyers to their clients are at the centre. ‘AIB Group,’4 a real estate development business, and ‘Mark Redler & Co Solicitors,’5 a law office that represented IB Group in a mortgage transaction, are parties to the lawsuit. IB Group claimed that Mark Redler & Co Solicitors violated their ‘fiduciary responsibility’6 by improperly discharging the mortgage money, causing a loss of £2.2 million. The High Court of Justice, Queen's Bench Division heard the case, and on March 23, 2011, the court handed down its decision.7
Because there was a significant sum of money at stake and the case involved a crucial amount of legal issues, it received a lot of media attention. It also emphasised the significance of the duty of care that solicitors have to serve clients as well as the potential repercussions of malpractice.
