Comparative Study On The Concept Of Lok Adalat With Reference To The Settlement Of Disputes Under The Alternative Dispute Resolution Mechanism

ABSTRACT

A condition of social peace and harmony is the peaceful resolution of disputes. The necessary condition for development is peace. The disputes and conflicts waste the society’s valuable time and the resources, a party who has been wronged should receive a swift, affordable and the trustworthy justice. The society’s passionate demand has always been for justice. The noble ideals of justice, liberty and the concept of equality should inspire the society regardless the type of the government it chooses, speed and reliable justice is the root of the real newline economical justice, India has inherited the its judicial system from the British which has its advantages as well as the disadvantages also. Any procedure that doesn’t follow the swift resolution of the issues at hand infringes on the fundamental right to the personal liberty. If the justice is delayed to any person it is considered as justice denied therefore there is a need to speed up the process of the alternative dispute resolution mechanism with the help of more and more Lok Adalat sessions held the cases can be disposed of easily and justice can be delivered without any delay and the burden of the courts. The administration of justice involves not only the protection of the innocent, punishment of the guilty, satisfactory resolution of the disputes but most importantly it focuses on the delivery of justice on time as it is crucial for the litigants so that they don’t end up spending a lot in the long process of litigation. The introduction of these modes of settlement of the disputes is necessary as it will benefit the parties as well as it would reduce the burden on the courts and this in turn will result in the efficient functioning of the legal system and the concept of Lok Adalat is important in the judicial system along with the alternative dispute resolution so that parties are at a win-win situation. The long pending cases can be settled with the help of Lok Adalat sessions which is a part of the alternative dispute resolution process for the speedy disposal of cases.
