ABSTRACT
The Consumer Protection Act of 2019 emphasizes the importance of providing particular protection to consumers who use e-commerce organizations. An intensive examination of the two recently ordered laws, i.e., Consumer Protection Act, 2019 and Consumer Protection (E-commerce) Rules, 2020, and Given the quick development and developing drift of e- commerce have changed customer inclinations to purchase online. This considers an analysis of the current Indian lawful system that ensures online consumers’ interface.
In respect of Product Liability, rise in consumer base has resulted in a significant increase in consumer products. As the production of commodities has expanded, so has the demand to make things that can be sold. As a result, any product that is unfit for usage must be removed from the market before causing customer discontent. As a result, the concept of a product recall was born. It is a procedure by which a corporation, on its own or with the help of the government, recalls a specific product that has already been sold on the market. The article will be based on a doctrinal study to analyze the pattern of product recalls in India and regulatory authorities of E-Commerce and their reasons. The study will also look into whether or not there is any existing or pending legislation that deals with a product recall and the analysis would also aid in the development of the same.
