Contracts Entered Into By Guardians On Behalf Of Minors: An Exception To The General Legislation

ABSTRACT

Contracts involving minors are void under the Indian Contract Act of 1872. Minors are people under the age of majority, or those under the age of 18. Throughout the years, we have seen various examples of contracts involving minors being deemed unenforceable and no particular performance being awarded to the parties.There is one exception to agreements made with minors which applies when guardians enter into contracts on behalf of the minors. The researcher will attempt to demonstrate how contracts entered into on behalf of minors by guardians are an exception to the typical regulations and how it may be a loophole for imposing specific performance against the minor in this study.
