ABSTRACT
Very critical debate is going on the various aspects of the recently passed the Citizenship (Amendment) Act, 2019 either in its favor or against. Both the supporters as well as oppositions have their justifications but subsequently, this law has been challenged in the Supreme Court under various provisions. Amidst the various confusions regarding its implementations and anticipated consequences on the rights of various peoples especially the poorer sections of society, this paper has tried to analyses amended law beyond current debates either in favor of CAA or against CAA while taking into consideration the proposed NRC and its relation with CAA.
The paper will analyze different aspects of CAA from critical perspectives of constitutionality and right of the people and its long terms effects on unity and integrity of the nation.
The main objective of this paper is to analyses its several loopholes due to which confusion and mistrust are prevailing among minority community and poorer sections of society as well as to suggest measures and means for removal of certain confusions regarding its provisions effective implementation by ensuring maximum compliance of this citizenship law. This in the end of the paper, certain constructive suggestions will be given.
