ABSTRACT
By drawing inferences from the newly legislated Digital Personal Data Protection Act, this paper presents a comprehensive analysis of the new regulatory compliances for personal data sharing, particularly its implications on mergers and acquisition (M&A) deals. It explores the crucial provisions that would affect businesses taking up deals involving corporate restructuring projects.
This paper discusses how cross border processing of data would be changed post the introduction of new regulations specifically highlighting the power of the judicial body in authorising such processing where restrictions have been imposed by the Government body. It dissects the exemptions granted to M&A transactions and obligations imposed in regard to transmitting the personal data of individuals.
In conclusion, this article not only throws light on legal compliance imposed on businesses engaged in corporate restructuring activities but also offers practical insights for the businesses to navigate their legal framework effectively without coming under the radar of authorities. India, through this Personal Data Protection Act seeks to not only bolster the trust and confidence of its citizens in the digital ecosystem but also foster an environment conducive to innovation and technological advancement.
