Decoding The Digital Personal Data Protection Act: A Critical Analysis

ABSTRACT


In an era, where every online activity of ours leaves a digital footprint- from ordering food to endless scrolling through reels even that latest online payment- safeguarding personal information in this vast cyber world is of utmost importance. But amidst this digital connectivity, how does one ensure security of his/her data from exploitation, that’s when Digital Personal Data Protection Act emerges as an answer to this crucial question. The act, passed in 2023, has at-least given a start to the data protection in this country and this article critically analyses the provisions of this act to answer whether the act balances the interests of individuals and legitimate concerns of the state. By exploring the nuances of this regulation, the analysis can contribute to a deeper understanding and clarity of the act for different stakeholders through a simpler language used in the article. While, the article acknowledges the legislative objectives behind this act, but whether those objectives have been fulfilled is an answer that this article seeks.
