Legal Empowerment Improves the Access to Justice


ABSTRACT


Legal empowerment means humanising the law and illuminating the justice. Distributive justice is all about the procedural fairness in the allocation and distribution of the societal, material, natural and national resources. Legal empowerment is the process of development of underprivileged or disadvantageous section of the society through the legislative programme and constitutional framework. The main attributes of the legal empowerment are the equal access to justice or the process of law and rule of law The Indian experience on the development of the backward section especially Scheduled Castes, Scheduled Tribes and women through the legal empowerment is legislatively successful. The Constitution of India is having the extensively provisions on the legal empowerment of the backward section of the society. Internationally the legal development is based on the Human Rights approach. The legal empowerment in India is arising out from the Fundamental Rights, Directive Principles of State Policy and the Affirmative Action of the State. This research paper is an attempt to explain some reflections from the legislative programme on the legal empowerment of poor in the light of the Constitution of India.
