Environment And The Indian Constitution

The Preamble of the United Nations Declaration on Human Environment1, adopted in Stockholm in June 1972 states, “Man is both creature and moulder of his environment, which gives him physical substance and affords him the opportunity for intellectual, moral, social and spiritual growth”.

ABSTRACT

Environment today is something of which we should be conscious about as it is the main component of our life on earth. It should be taken care of in every means even after maintaining sustainable development. This article aims at environment protection with the help of the laws in constitution. The Constitution of India is not a black and white text but an alive and evolving text over time. The specific provisions on environmental protection in the constitution is also a reason of this progressing nature and the potential for development of the basic laws of the land.

The socialist socialism of our society and the inherent worth of every person are guaranteed by the preamble of our constitution. This by nature has a high standard of life and a comfortable atmosphere. The Environment (Protection) Act,19862 defines the environment as “the water, air and land and the inter-relationship which exists among and between water, air and land, and human beings, other living creatures, plants, micro-organism and property”
