Environmental Protection Under Islamic Law: A Partial Comparison With Indian Law

ABSTRACT
The ongoing environmental crisis is so serious and dangerous that it has sensitized the entire humanity and the world. According to Islamic religion, Allah created this universe in six days and six nights before sending humans to the planet. During this time, he produced an atmosphere that is 78% nitrogen (N), 21% oxygen (O), and 0.03% carbon dioxide (CO2), among other gases, to maintain a cosmic balance. Allah has made two- third of the earth with salty water and one-third with land and over the land there is Mountain so that the land may not get shaken. Some specific portion of the land must have green plant. After creating this in right Proportion, Allah asked the men to spread over the earth and searches the bounty of Allah without making corruption. Under Islamic law Corruption means disturbing the balance created by Allah. Under Islamic law man is the Trustee and the other living being including men who are beneficiaries. But in today’s world men have by his hand has polluted the land and water. Numerous verses in the Quran and Hadith of the Prophet (PBUH) forbid men from polluting the environment. The rightly guided Caliph continued to carry out the dictum of the Quran for the protection of the Environment. The Constitution of India also contain provisions for the protecting of the environment. Recently, the Indian Supreme Court handed down many major decisions in support of environmental protection. In this article we shall discuss the Islamic Approach of Environmental Protection and we shall make a comparison with Indian law. Dealing with the environment is providing the social justice to the people. Environmental Pollution is Fasad-fil-Ardh means ‘Corruption on land’ and whoever spreads corruption on land is waging war against the God or Allah and shall be punished accordingly.
