ABSTRACT


The proliferation of e-contracts in the digital age has revolutionized the way businesses and individuals enter into agreements. While the convenience and efficiency of e-contracts are undeniable, they also raise significant ethical considerations that warrant careful examination. This paper explores the ethical implications associated with e-contracts, focusing on issues such as consent, privacy, accessibility, security, and the digital divide. Consent in e- contracts often becomes questionable due to complex terms and conditions that users may not fully understand or even read, raising concerns about informed consent and autonomy. Privacy concerns are paramount as e- contracts frequently involve the collection and processing of personal data, posing risks of data breaches and unauthorized use of sensitive information. The issue of accessibility is critical, as not all individuals have equal access to digital technologies, potentially marginalizing certain groups and exacerbating the digital divide. Security is another vital ethical consideration, as e-contracts can be vulnerable to cyber-attacks and fraud, necessitating robust measures to protect against such threats. This paper argues that addressing these ethical issues requires a multi-faceted approach involving stronger regulatory frameworks, technological solutions, and heightened awareness among stakeholders. It emphasizes the need for transparent practices, user-friendly interfaces, and stringent data protection measures to ensure that e-contracts are not only legally sound but also ethically justifiable. By exploring these ethical dimensions, this paper aims to contribute to a more comprehensive understanding of the challenges and responsibilities associated with e-contracts in the modern digital landscape.
