ABSTRACT


Child abuse in India is a pressing issue, addressed through the 2012 Protection of Children from Sexual Offences (POCSO) Act. Evidentiary procedures are pivotal in prosecuting offenders under this act, with medical examinations assuming a central role. In cases lacking eyewitnesses, medical examinations become vital in establishing guilt beyond reasonable doubt. This research paper aims to delve into the evidentiary value of medical examinations in the context of child sexual abuse cases, offering a critical analysis of their role in substantiating elements of the offense. Furthermore, the paper aims to assess the role of expert witnesses and the reliability of examination methodologies employed in such cases.
