ABSTRACT
The death penalty, whether in India or elsewhere, has always been a contentious issue, with endless debates surrounding its morality and constitutionality. This paper examines the constitutionality of the death penalty in India in light of the Indian Constitution. In addition, the paper sheds light on the historical context, landmark decisions, and recent trends in decisions regarding the death penalty in India. The purpose of the study is to determine the constitutionality of the death penalty and the significance of varying judicial opinions regarding its constitutionality.
