Force And Criminal Force - A Comparative Study

ABSTRACT


Force and Criminal force under Indian Penal code, 1860 both have different meanings. In this research paper it is explained in a very detailed manner what is the basic difference between these two sections and what is the judicial approach where we will study a few cases where this concept was raised and decided upon.


People commonly confuse Section 349 and 350 that is Force and Criminal force as it is the same but both the definitions in Indian penal code tells a different concept which we will be discussing in the paper. Force is the definition of what actual force is whereas criminal force is an offence. Various elements will be discussed in depth of what are elements which are mentioned under force and what are elements which are mentioned under criminal force.


As all the mentioned offences in the Indian penal code - the nature of the offence is not very high, there are more serious offences like Murder and Kidnapping and some people do not even have the knowledge that this trivial matter is an offence.


Thus this research paper will discuss every aspect of force and criminal force in Indian penal code and will provide us with the basic and crucial knowledge of the offence.
