ABSTRACT

Our Indian Constitution is the key source of the laws of the land. Though we are aware of most of the rights and duties specified in it, still we remain ignorant towards the reproductive rights of women in India. In the recent years several cases with several remarkable decisions recognised the reproductive rights of a women as empowered under the Indian Constitution Article 21, as a non- negotiable right. It includes the freedom of a woman to take decision regarding her pregnancy.

In this paper the key issues faced by women when it comes to her freedom to choose with whom and when to get pregnant and with her sole consent using a doctrinal research carried out with the help of data and information gathered from articles, journals and other resources. One can find the nuances of reproductive choice and the presence of the regarded freedom is too her right with the same being discussed in detail.
