ABSTRACT
This research article examines the fundamental rights of prisoners in India and the challenges they face in accessing these rights. Despite being guaranteed fundamental rights under the Indian Constitution, prisoners in India face a host of issues that make it difficult to exercise their rights. The prison system in India is plagued by overcrowding, inadequate medical facilities, and discrimination. This article delves into the constitutional and legal provisions that safeguard the rights of prisoners and the prison system in India.
The challenges encountered by prisoners in India to access their fundamental rights are manifold. Additionally, insufficient rehabilitation programs can impede their ability to reintegrate into society and exercise their rights after release. While the Indian Constitution and legal system provide protections for prisoners' fundamental rights, they still face numerous challenges in exercising these rights. Overcrowding, lack of medical facilities, and discrimination against specific groups of prisoners are significant impediments. Although the Supreme Court has made landmark judgments, more must be done to safeguard the fundamental rights of prisoners in India.
