Historical School Of Jurisprudence: A Critical Analysis

ABSTRACT

Jurisprudence is an area or subject of law that is partly vague and also very vast and not structurally defined with solid evidence or consensus, it is a subject of law that relates law to almost anything and everything that exists in the real or contemporary1 world that we live in. Due to its vastness and it being vague in nature, many jurists and scholars have tried to define and associate jurisprudence and law in different ways that have different beliefs and approaches. These so called multi-faceted2 views and approaches have been advanced to what we call schools of law in todays world. There exist many schools of law but the one relevant to this paper is the “Historical school of Jurisprudence”. The historical school of jurisprudence states that the laws of the land are not made by humans but are rather advanced through the cultures, customs, social needs, economics state and religious principles.
