Human Rights In Ensuring Justice For Prisoners

ABSTRACT


It analyses the issue of concern of prison overcrowding in South Asian countries, focusing particularly in India where the correctional facilities are working at 131% of the planned capacity. It adds to the troubling number of prisoners awaiting trial that have risen rates of mental health problems, such as depression and suicidal thoughts ideation. The analysis focuses on the recent legal developments, such as a later, crucial Supreme Court decision striking down the constitutionality of caste-based labor division amongst prisoners. According to experts, this ruling also necessitates change in jail manuals across state, eradicating caste based discrimination, which is a major step in enforcing dignity of human beings in the Indian correctional system.


The research also investigates geographic relation and socioeconomic effects related to overcrowding, along with a detailed examination of National Crime Records Bureau (NCRB) report that highlight the core of the issue. Through an evaluation of recent policy changes and their implementation challenges, this investigation proposes increasing legal proceedings and considering alternatives for minor one as key approaches to reduce overcrowding.


Furthermore, report from a joint study by the Psychiatry Department of King George's Medical University (KGMU) bring light on the mental effects of particular crowd on inmates and emphasize the lack of mental health practitioners in Indian prisons compared to neighbouring nations.
