Impact Of The Jan Vishwas (Amendment Of Provisions) Act, 2023 & The Digital Personal Data Protection Act, 2023 On The Information Technology Act, 2000

Introduction

This monsoon session of the Indian Parliament witnessed the introduction and enactment of many new legislations. On the one hand, we finally got the long overdue Digital Personal Data Protection Act, 20231 (hereinafter referred to as “DPDP Act”) to protect ourselves from an unwarranted invasion of privacy and on the other hand parliament enacted the Jan Vishwas (Amendment of Provisions) Act, 20232 (hereinafter referred to as “Jan Vishwas Act”) to decriminalise and rationalise offences. In this article, an attempt has been made to figure out the impact of the DPDP Act and Jan Vishwas Act on the Information Technology Act, 20003 (hereinafter referred to as “I.T. Act”).
