Indian Judiciary: Protecting The Right Of Prisoners

Abstract


Our country although being a democratic country and the believer of Human rights yet not have codified laws for protection the rights of the prisoners. However, it cannot be said that the judiciary unlike other democratic organs have not taken initiative to protect the right of the prisoners. Through various valuable judgments and interpretations Honorable judiciary has played prime role. The rights available to the prisoner has evolved and they are still evolving and along with this prison reformation is been demanded by the people. If a person is convicted than too some basic human rights and other rights are available to him or her although they come with certain constitutional restrictions.


This paper extensively talks about the various rights available to the convicts (prisoners) under the constitutional and legal framework. The paper also highlights the role played by the judiciary by passing judgments and directions and discusses the prominent case laws pertaining to each right possessed by the prisoners
