Intellectual Property Rights In The Age Of Artificial Intelligence: Challenges And Opportunities

ABSTRACT


The rapid advancement of artificial intelligence (AI) technologies poses significant challenges and opportunities for intellectual property (IP) rights. As AI systems become more capable of generating creative works, the traditional frameworks for IP protection are facing unprecedented strains.


Laws and artificial intelligence are approaching a point when they need to be updated to reflect new developments in technology. Artificial intelligence is evolving quickly, and there's a chance it will replace many human endeavors in the future, including the legal profession. Attorneys and their teams invest a great deal of time in comprehending and arranging patent claims. Investigating and evaluating the uniqueness, practicality, and non- obviousness of goods and procedures for which a claim is to be made takes hours of work. Obtaining a patent requires a significant financial investment. AI-enabled legal facilitation could significantly reduce the time and cost associated with the procedure.


This article has discussed how the disruptive effects of artificial intelligence are being accommodated by exaggerating the definition of intellectual property to the breaking point and the opportunities. Put another way, it is ironic that protecting artificial intelligence with respect to intellectual property ends up undermining the core principles of intellectual property law.
