Jurisprudential Fusion: Examining Legal Theories And The Nature Of Obligation

ABSTRACT

Legal theorists for centuries have been contextualizing various theories to explain the origins of law, the necessity of the same and how its application leads to obligation in society. This paper looks into the need for law and the requirement of its application in society. With this paper, I would first argue how HLA Hart’s soft positivism along with Hobbes’ and Punfendorf’s theory on natural law brings forth, in my opinion, the correct theory of law in all the aforementioned aspects. With the aid of current social instances and world affairs, I would explain the varied effects obligation to laws have on different sects of society.
