Laws Related To Insolvency And Banking In India With Special Reference To The Insolvency And Bankruptcy Code, 2016: An Overview

ABSTRACT


“Bankruptcy is a gloomy and depressing subject. The law of bankruptcy is dry and discouraging topic.”


However, depressing the terms ‘insolvency and bankruptcy’ may sound like they represent the opposite, beneficial, and helpful efficacy in the economic and financial ecology. Therefore, without comprehending the essential words as they have been stated below, no comprehensive and valid diagnosis of an insolvency regime could be made. So, an effort is made in the present study to discuss the general overview of the various legislative provisions related to insolvency and banking with special reference to the Insolvency and Bankruptcy Code, 2016. A discussion is also made on the various shortcomings that require amendments for the proper implementation of the provisions of this code.
