ABSTRACT
Marriage is one of the purest things on the earth, marriage is not only about fulfilling someone's sexual pleasure but also an understanding of each other. This article talks about forceful sexual intercourse after marriage i.e. marital rape: as a solid ground for divorce. In this article, we talk about the history of the marital rape. Compare the condition of marital rape in other countries to India. Women's rights and dignity after marriage. Each and every one of the society have the right to make decisions about their life but we have seen that after marriage women do not have their full rights and privileges against their husbands. The presumption of the concept of once the consent is always the consent. Marital rape is not an offence in our country but it is a solid ground of divorce. Mostly women face this problem and this also affects their health condition. Marital rape is very much a concern to academicians, researchers and feminists to be aware of the women to say no to sexual intercourse if someone forcefully tries to do sexual intercourse with them. Women should know about their rights and privileges given to them. In this paper, we have an analysis of the data of marital rape from the different countries. There are some countries where marital rape is considered an offence and punishment is given to offenders. In India, women are not aware of their rights after the marriage and who knows they do not come up because they are afraid of their family respect and reputation. This paper discusses the rights and privileges of women who are not aware of and encourage other to move to the Court. This paper is all about serving justice in society against this heinous activity done by the husbands. This paper also provides information to husbands to understand this heinous activity coming over the centuries. So, they can understand the feelings and pain of women who are suffering from this heinous practice.
