Marital Rape: Demystifying ‘Consent’ Within Marriage

ABSTRACT

IPC recognize all kind of rape but there are no provisions for marital rape. Even having section 375, marital rape was not part of this section. there are some cases which tell us about the current situation of marital rape in India. Parliament have fear that the Law on marital rape will also increase cases of harassment against men. According to The World Bank, more than 100 countries made marital rape a crime in their country but India comes in the list of 36 countries where marital rape is not criminalized for some reason. People have confused about this topic and have questions in their minds. One question is why marital rape was not criminalized in India? Different state courts have given their views on marital rape.
