ABSTRACT


This paper explores the complex issue of obscenity, balancing freedom of expression with societal standards of decency. The study examines the legal definition of obscenity, its evolution over time, and the societal perspectives that shape its acceptance. Special focus is given to how different legal frameworks, such as the Indian Penal Code (IPC) and the proposed Bharatiya Nyaya Samhita, address obscenity. By reviewing case laws and analyzing societal shifts, the paper aims to highlight the ongoing debate between the right to free speech and the need to maintain moral standards.
