On Transformative Constitutionalism: A Critique

ABSTRACT


The idea of transformative constitutionalism seems alluring in the twenty- first century when countries are eager to outdo each other to meet democratic ideals. While doing so, one needs to be aware of the constitutional foundations of their nation. Every country has a unique character, and exists within a legal culture that is similar to none. Keeping that in mind, this article shall try to understand the concept of transformative constitutionalism and how it plays out in the presence of various factors like constitutional and public morality, global order, among others.
