Protection Of Intellectual Property Rights

INTRODUCTION

Intellectual Property Rights are the legal ownership of intangible objects such as literary and artistic works, names, commercial symbols pictures and inventions. Intellectual Property Rights in India are important for competitiveness and economic growth. In recent years, the government has made great progress to modernize its Intellectual Property Rights framework. The three basic types of Intellectual Property Rights are Copyrights, Trademarks and Patents. The Indian Government has implemented various laws and regulations for the enforcement of Intellectual Property Rights and to avoid their infringement.

Intellectual Property Rights have become a topic of substantial importance in India. They are the legal rights to protect an invention or product which is granted to the inventor or manufacturer. These rights prohibit everyone else from using the IP without the prior consent of the Intellectual Property Rights holder for commercial purposes.

Intellectual Property Rights include copyrights, trademarks, patents, geographical indications, layout design, trade secrets, utility models, industrial designs, layout design of integrated circuits, related rights and new variety of plants. Intellectual Property plays a crucial role in the modern economy.

Intellectual Property Rights is a strong tool to protect the effort, money, investment and time invested by the creator/inventor of the Intellectual Property. It gives the creator/inventor an exclusive right for the use of its creation/invention for a certain time period.

A patent is an exclusive right given to its owner for the invention of a process or product that offers a new way of doing something.
