Religious Pluralism And The Uniform Civil Code: Navigating The Intersection Of Personal Beliefs And Legal Uniformity

Adv. Priya Tripathi, Parul University, Baroda

ABSTRACT

In nations where several religious communities coexist, the topics of religious pluralism and the Uniform Civil Code (UCC) have long been explored. Multiple religious traditions are acknowledged, and religious pluralism promotes their acceptance and equality. Regardless of a person's religious affiliation, the UCC suggests a single set of laws that would apply to personal concerns including marriage, divorce, inheritance, and adoption. The deeply ingrained religious practices and beliefs of many communities present difficulties for religious plurality in the framework of a uniform civil code. Religious organizations frequently claim that enacting a Uniform Civil Code will violate their right to religious liberty.

One strategy for striking a balance between individual convictions and legal uniformity is to advocate for a legal framework that acknowledges the variety of religious convictions and practices while upholding fundamental rights and gender equality. Focusing on topics where numerous religious communities have broad agreement is another strategy. A culture of religious tolerance and understanding must be fostered, and this requires public education and discussion.

Keywords: Religious pluralism, Uniform Civil Code, marriage, divorce, inheritance, and adoption, organizations, strategy, striking, fostered, education.
