ABSTRACT:
This legal essay evaluates the legal frameworks and regulations surrounding technology-related medical negligence in Nigeria. It addresses key research questions regarding the legal frameworks’ adequacy in addressing challenges posed by technological advancements, the implications of negligence on patient safety and access to justice, and the need for proper regulations. The essay examines specific risks and challenges, such as technical failures and knowledge gaps, and highlights the inadequacy of existing laws, including the Nigeria Health Act and Medical and Dental Practitioners Act and Criminal Code Act. It advocates for amending and enacting new laws that specifically address technology-related errors, emphasizing the importance of collaboration, education, regulation, research, and the domestication of international guidelines. The essay concludes with recommendations aimed at enhancing legal frameworks to improve patient safety and healthcare quality in Nigeria.
