ABSTRACT
Workplace sexual harassment remains a global issue, with significant implications for individuals, organisations, and societies. The recent enactment of the Bharatiya Nyaya Sanhita, 2023,Bharatiya Nagarik Suraksha Sanhita,2023, and the Bharatiya Sakshya Adhiniyam, 2023 (BSA) marks a significant development in India's legal landscape, aiming to address various forms of crime, including sexual harassment. This study examines the provisions of these new laws relevant to workplace sexual harassment and analyses their potential impact on preventing and addressing this issue.
The research employed a mixed-methods approach to examine the interplay between new criminal laws and workplace sexual harassment. A comprehensive review of the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita,2023, and the Bharatiya Sakshya Adhiniyam, 2023 (BSA)was conducted to analyse provisions related to sexual harassment. Additionally, a survey-based analysis was undertaken to assess the prevalence of sexual harassment, reporting mechanisms, and the impact of existing laws and policies.
