The Role Of Digital Courts In Reinforcing The Integrity Of The Judicial System

ABSTRACT


The introduction of digital courts is a major change that will bring improvements in the efficiency, transparency, and access to the administration of justice and will, at the same time, present some challenging views of a judicial integrity issue. This paper gives an in-depth analysis of the role of the digital courts in improving the integrity of the judicial system and also looks at how digital courts relate to procedural fairness, case management, evidence control, public accountability, and institutional resilience. By relying on a synthesis of theoretical discussion, comparative case studies, as well as on the observation of the practical uses, the paper will argue that the concept of digital courts, properly designed and implemented with the right kind of safeguards will enhance the integrity of legal institutions by reducing their exposure to corruption; by promoting predictability and consistency in trial outcomes and by increasing the opportunities of external checks and balances. The paper also establishes frailties that come with the issue of algorithmic opacity, digital exclusion and a breach of privacy in case reforms are sought without having the necessary protective mechanisms. Lastly, the paper will provide policy suggestions regarding the incorporation of technological solutions in a way that puts the emphasis on the aspects of due process, data security, accessibility, and humanity centred judicial principles.
