Trademark Infringement In The Indian Sports Industry: An Analysis Of Legal Framework And Case Studies

ABSTRACT
This research analyses the problems of trademark infringement in the Indian sports sector and evaluates the legal system in place to safeguard intellectual property. The Trademarks Act, 1999, which allows for the registration of trademarks and gives the owner the sole right to use the trademark in connection with the products or services for which it is registered, is the main law controlling trademarks in India. In order to highlight the problem of trademark infringement in the sports business, the article uses case studies, such as the well-known incident involving the Chennai Super Kings and Rajasthan Royals in the Indian Premier League. In addition, the article analyses the difficulties in protecting trademark rights in the sports sector, such as the length of the legal process and the ignorance of prospective infringers. The paper concludes by emphasising the importance of trademark protection in the sports industry and the need for trademark owners to be vigilant and take proactive steps to protect their trademarks.
