Dr. Munish Swaroop & Mr. Nikhil Bajpai, Assistant Professor, ICFAI Law School, IFHE, Hyderabad, Telangana

ABSTRACT

The digital era has fundamentally altered how crimes are investigated and evidence is presented in legal proceedings. The proliferation of technology and widespread internet usage has made electronic evidence (E-Evidence) and Cyber Forensics pivotal in combatting cybercrimes. This shift presents a significant challenge for law enforcement and legal professionals as cyber criminals exploit the virtual landscape for illicit activities.

E-Evidence encompasses a broad spectrum of digital data, such as emails, instant messages, social media interactions, cloud storage, and browsing history. Cyber Forensics involves the scientific examination and analysis of this digital evidence to unravel cybercrime.

This paper delves into the core principles of Cyber Forensics, including the identification, preservation, extraction, and analysis of digital evidence while ensuring its integrity and admissibility in court. Despite cybercriminals attempting to conceal their digital footprints, forensic investigators employ tools and methodologies to trace events and identify perpetrators. Additionally, the paper explores legal challenges and ethical dilemmas surrounding E-Evidence and Cyber Forensics. Privacy concerns, maintaining chain of custody, and adhering to data protection laws significantly impact the admissibility and trustworthiness of digital evidence in court. The evolving technological landscape necessitates continual updates to legal frameworks to accommodate digital investigations.

E-Evidence and Cyber Forensic techniques are indispensable in combatting cybercrimes. As cyber threats evolve, ongoing research and innovation in this field are crucial. Integrating technology, law, and forensics effectively empowers society to proactively tackle cybercriminal activities, safeguard the virtual realm's integrity, and uphold justice in the digital age.
