Tanya Bhattamishra, B.A. LL.B. (Hons.), University School of Law and Legal Studies

ABSTRACT

The word "Constitution," which has French antecedents and is typically used to refer to laws and regulations. The basic law of the land with higher power and purity is the Constitution of any nation. In addition to outlining the essential tenets of the State, the mechanisms and procedures of government, and the fundamental rights of individuals, it also charts a course for a country's future growth and development. After India gained independence, the objective of those who drafted its constitution was to create a workable system of government that would best serve the country while maintaining the importance of the people. Therefore, they ensured that the Indian Constitution was an amalgamation of the best provisions of various constitutions around the world, one of them being the United States of America.

Even though the countries have incorporated the similar provisions into their Constitutions, they have adapted them to meet the social, economic, political and cultural needs of their country, which makes it imperative to understand the reasons and effects of many contrasting provisions of the constitutions of India and USA.
