ABSTRACT


The bail jurisprudence of India is disjointed, applied inconsistently, and frequently discriminatory, especially against the weak. This paper looks at the shortcomings in the current bail laws and makes the case for creating a new bail law. A rights-based, consistent, and standardized approach to bail is suggested, drawing on reports, case law, and comparable international standards.
