A Study On Impact Of Custodial Death In India

ABSTRACT

The custodial death is of mistreatment is death in custody. Most often, it occurs when a police officer kills a felon by using excessive force, abusing their authority, and torturing them beyond what is permitted. The term "custodial death" refers to a situation in which an arrested person died while being tortured by the police or other officers in charge of their care, whether they were police officers or magistrates The major objective of the Study was to know about the custodial death and causes of the custodial death and also the author intends to know about the situation of the custodial death during pandemic situation and the author also intends to know about the role of national human rights commission and state human rights commission in preventing the custodial death and also about the defences taken by the police officers after causing the custodial death and the researcher also wanted to know whether the custodial death can be prevented through the modernization of the prison and strict surveillance of the prison. The researcher has done an empirical study. The researcher used a convenient sampling method to get the samples and the bar graphs and pie charts are used by the researcher for the SPSS. The primary and secondary sources were collected through questionnaire, magazine, journal, books and articles. The researcher has taken around 200 samples by the way of the survey . according to the statistics analysed the author finds that the custodial death scale is going up and down like an business cycle but never ends so the custodial death still prevails in the society and may have a chance of increasing in the future.
