ABSTRACT


The paper explores the significance of medical and forensic science evidence in investigating cases of sexual offenses in India. It emphasizes the critical role of medical practitioners in providing both medical treatment and assistance in legal proceedings for survivors of sexual violence. The paper discusses the legal framework governing medical examinations in cases of sexual offenses, highlighting the amendments in relevant laws and judicial interpretations. It also examines the ethical guidelines established by the Ministry of Health & Family Welfare and WHO for the care of survivors of sexual offenses. Additionally, the paper delves into the reliability of expert evidence in sexual offense cases and its impact on judicial pronouncements. Through case studies and analysis of judicial trends, the paper underscores the importance of medical and forensic evidence in determining the occurrence of sexual offenses and securing justice for survivors. The conclusion emphasizes the need for timely reporting of cases, improvements in investigative procedures, and adherence to scientific reasoning by medical practitioners.
