INTRODUCTION


A three-judge bench of the Supreme Court Of India, in the case of Aghnoo Nagesia v State Of Bihar1, interpreted the implementation of section 25 of the Indian Evidence Act, 18722 to an captivating realities where Aghnoo Nagesia gave a full blown confession of first information report describing that he had done the murders.


The court laid down that section 27 of the act, acts as the only exception to section 25 of the act, to which the court supposed Aghnoo Nagesia to be in the ‘constructive custody’ of the police and thus acknowledged the information which was relating to the discovery of evidences like murder weapons and the bodies.
