ABSTRACT


The integration of Artificial Intelligence (AI) into the Indian judicial system presents a transformative opportunity to enhance efficiency and accessibility. However, this technological advancement brings forth a significant challenge: the risk of algorithmic bias. This report provides a detailed analysis of algorithmic bias within the Indian legal context, examining its definition, various types, and potential sources. It explores the current landscape of AI applications in the judiciary, supported by empirical data and real-world examples, and analyzes how algorithmic bias can lead to violations of fundamental human rights as enshrined in the Indian Constitution. Through a comparative legal study with other jurisdictions like the US, UK, and EU, this paper highlights instances of AI bias and their regulatory responses. It critically assesses the adequacy of India’s existing legal and regulatory framework to address this critical issue and concludes with actionable recommendations for ensuring fairness, accountability, and ethical AI adoption in the Indian judiciary.
