Alternative Dispute Resolution In Family Disputes: An Indian Legal Perspective

ABSTRACT


This paper explores India's matrimonial systems, ADR mechanisms applicable to family disputes, and the legal provisions supporting non- adversarial resolutions.


Alternative Dispute Resolution (ADR) has become a crucial mechanism for resolving family disputes in India, particularly in matrimonial conflicts. Given the diversity of personal laws governing marriage and family matters, ADR methods like mediation, conciliation, arbitration, and Lok Adalats provide amicable, cost-effective, and speedy solutions. Given the adversarial nature of litigation and its impact on familial relationships, ADR mechanisms offer a structured, non-confrontational approach to dispute resolution, ensuring privacy and facilitating mutually acceptable solutions. This paper explores the role of ADR in family disputes, its legal framework, effectiveness, challenges, and future prospects from an Indian legal perspective, examining statutory frameworks, judicial precedents, and recommendations for strengthening ADR in India.
