An Analysis Of The Draft Telecommunication Bill, 2022

ABSTRACT

Amidst this technological evolution which has provided an increasing number of options for users to peruse and with increasing number of challenges, there is an ever-increasing need to regulate the telecommunication sector, keeping in view the upcoming challenges. The sector has been regulated till now by the Indian Telegraph Act of 1885, the Indian Wireless Telegraphy Act, of 1933, and The Telegraph Wires (Unlawful Protection) Act, of 1950. These legislations are very old and considerably outdated with the most recent of them enacted 70 years before. To address this issue, recently the Department of Telecommunications has presented a Draft Telecommunication Bill which aims to consolidate the above-mentioned acts as well as add provisions related to new-age challenges being faced. The bill also aims to “restructure the legal and regulatory framework” in the telecommunication sector.

This article is an attempt to study a few important provisions of the bill. It analyses the plus points and the lacunas and give an unbiased view of the bill.
